OPEN ONLY to alumnae members of Delta Gamma Fraternity who have paid their per capita dues by February  12, 2024, or are exempt from paying per capita dues as they are a 50-year member and who are at least twenty-one (21) years old at the time of entry. Due to the nature of the prize awarded, the Grand Prize winner’s guest must also be an alumnae member of Delta Gamma who has paid their per capita dues for the fiscal year by February  12, 2024, or is exempt from paying per capita dues as they are a 50-year member.

This sweepstakes is sponsored by Delta Gamma Fraternity (the “Sponsor”). This promotion may be advertised on but this promotion is in no way sponsored, endorsed, or administered by, or associated with, Facebook or Instagram.

Convention Adventure Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States (and the District of Columbia) and Canada (excluding Quebec), who are at least twenty-one (21) years old and alumnae members of Delta Gamma Fraternity who have paid their per capita dues for the biennium by February 12, 2024, or are exempt from paying per capita dues as they are a 50-year member. Void where prohibited. Proof of residency, age, and good standing may be required. Employees and Cabinet-level volunteers of Delta Gamma Fraternity, Delta Gamma Foundation, and Delta Gamma Office of Housing and the immediate family and household members of such individuals are not eligible to win. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, step-siblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three months a year, whether related or not. In order to enter the Sweepstakes or receive a prize, you must fully comply with the Official Rules and, by entering, you represent and warrant that you agree to be bound by these Official Rules and the decisions of the Sponsor, whose decisions shall be binding and final in all respects relating to this Sweepstakes. The Sweepstakes is governed by these Official Rules and is subject to all applicable federal, state, and local laws.

Sweepstakes begins February 19, 2024, at 12:01 a.m. Eastern Standard Time and ends March 4, 2024, at 11:59 p.m. Eastern Standard Time (“Sweepstakes Entry Period”). Sponsor is the official timekeeper for this Sweepstakes.

During the Sweepstakes Entry Period, you may complete the online entry form and clicking submit (the “Submission”). You will be required to confirm that you have read and agree to be bound to the Official Rules. ALL ENTRIES MUST BE RECEIVED BY 11:59 PM EST ON March 4, 2024. Limit of one entry per member during the Sweepstakes Entry Period. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries all of which will be ineligible to win a prize. In the event of a dispute as to any entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner of the prize may be required to show proof of being the authorized account holder to be awarded the prize. All entries become the sole and exclusive property of Sponsor and will not be returned or cancelled.

Two (2) First Prizes will be awarded, each consisting of a gift basket with Delta Gamma Fraternity and Convention 2024 merchandise. (Approximate Retail Value (ARV of each First Prize: $50.)

One (1) Grand Prize will be awarded, consisting of: (a) round-trip coach air transportation for two (2) to Palm Desert, CA (the “Destination”), from a major commercial airport in the United States or Canada, nearest to the winner’s primary residence provided that the Sponsor reserves the right to substitute ground transportation for air transportation if winner resides within 150 miles of the Destination; (b) one (1) hotel accommodation for four  (4 ) nights in Palm Desert, CA (one double occupancy room and room tax only) checking in on June 26, 2024  and checking out on June 30, 2024; (c) two (2) registration fees for Delta Gamma Fraternity’s 2024 Convention (the “Event”); (d) two (2) seats at all official meals during the Event; (e) gift basket with Delta Gamma Fraternity 2024 Convention merchandise and Palm Desert themed merchandise; and (g) ground transportation to and from the airport for both flights. (Total Approximate Retail Value (ARV): $4000.)

GRAND PRIZE WINNER AND WINNER’S GUEST SHALL HAVE NO RIGHT TO SELL ANY PART OF THE PRIZE PACKAGE; IF SPONSOR DISCOVERS THAT ANY PART WAS SOLD, GRAND PRIZE WINNER AND WINNER’S GUEST SHALL BE SUBJECT TO LEGAL ACTION. In no event shall more than the number of stated prizes be awarded. All prizes will be awarded.

All other expenses specifically not mentioned herein, including without limitation, ground transportation, transfers, additional hotel amenities (i.e. spa services, Internet access, phone calls, laundry services), fees and gratuities, airline change fees, airline premium seat fees, airline baggage fees (both checked and carry on), personal expenses such as meals not provided during Event, photos, souvenirs, and passport fees, are the responsibility of the Grand Prize winner and traveling companion. Travel and hotel accommodations are subject to availability. If Event is cancelled for any reason, Sponsor’s only obligation is to award the other elements of the prize. If selected, if Grand Prize winner is unable to travel on dates required the selected Grand Prize winner will forfeit the prize and another Grand Prize winner will be selected from among eligible entries received. Grand Prize winner and guest must travel on same itinerary. No prize substitution, cash substitution, or assignment or transfer of prizes is permitted, except by Sponsor who may substitute a prize of equal or greater value if any portion of the advertised prize becomes unavailable. In no event shall more than the number of stated prizes be awarded. All prizes will be awarded. Any un-used elements of the Grand Prize will be forfeited, will not be redeemable for cash and may not reduce the prize value awarded for tax purposes. All federal, state, local and other taxes, costs and expenses relating to the use, acceptance, and possession of the prize are the sole responsibility of the winner. Grand Prize winner will receive an IRS Form 1099 for the actual value of prize awarded. Actual retail value of prize depends upon location of Grand Prize winner and fares at time of departure.

Winners will be determined in a random drawing on or about March 3, 2024 from among all eligible entries under the supervision of an independent panel of judges from Sponsor whose decisions are final and binding. All potential winners will be notified by telephone and must respond within one (1) business day to give a valid email address where notification of potential winner status and required documents can be sent. Additionally, as a condition of receiving any prize, a potential Canadian winner must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered at a mutually convenient time by telephone. Failure to correctly answer the skill-testing question within the time period provided will result in disqualification and selection of an alternate potential winner. Except where prohibited, acceptance of prize constitutes winner’s consent, and winners and Grand Prize winner’s guest will be required to sign a release, to allow Sponsor and its promotional agents to use winners’ and Grand Prize winner’s guest’s name, likeness, photo, video footage, and/or biographical data for advertising and promotional purposes, without additional compensation, in perpetuity, in all media, now known or hereafter developed, in connection with Sponsor, this sweepstakes, the Sponsor’s web sites, magazine, social media accounts, and the Event. Winners and Grand Prize winner’s guest(s) will be required to sign and return to Sponsor an Affidavit of Eligibility, Publicity & Liability Release (“Affidavit”) and/or IRS Form W-9 (if required by IRS regulations), prior to and as a condition of acceptance of prize, within three (3) business days of receipt of notification or prize will be forfeited and an alternate winner selected. Grand Prize winner’s guest must also sign and return a liability and publicity release within three (3) business days. Verification of Grand Prize winner’s guest’s membership and good standing in Delta Gamma Fraternity must also be verified before prize will be awarded to Grand Prize winner. Prizes will be awarded within 90 days after receipt and verification of completed prize notification. If prize notification is undeliverable, or if a potential winner does not respond to the prize notification telephone call within the time specified or if the potential winner cannot be contacted for any reason,  including an invalid telephone number, during the time Sponsor must reach, if the Affidavit is not complete and received by the Sponsor within the time required, or in the event of non-compliance with these Official Rules, the prize will be forfeited, and an alternate winner will be selected at random from the remaining eligible entries. All travel companions must be at least 21 years old at the time of travel.

By entering this sweepstakes, any personal information entrants submit will be disclosed to the Sponsor and will be used only by us for the limited purpose of verifying eligibility to enter and contacting potential prize winners. This promotion may be advertised on Facebook and/or Instagram but entrants will be providing information to Delta Gamma Fraternity and not to Facebook or Instagram.

Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these Official Rules. If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this sweepstakes, or if technical difficulties or technical corruption (including a computer virus or system malfunction) compromise the integrity of the sweepstakes, Sponsor reserves the right to terminate the sweepstakes and select winners from among all eligible entries received prior to termination. Should the sweepstakes be terminated prior to the stated expiration date, notice will be posted at convention.deltagamma.org. Any attempt to deliberately damage the content or operation of this drawing is unlawful and subject to legal action by the Sponsor and its agents. You agree, on your own behalf, and on behalf of your heirs, executors, administrators, legal representatives, successors and assigns (“Releasing Parties”), hereby release, and agree to defend, indemnify, and hold harmless the Sponsor, those working on its behalf, Facebook, and all other businesses involved in this sweepstakes (including prize vendor/provider), as well as each of their respective employees, officers, directors, agents and representatives, successors and assigns (“Released Parties”), from any and all actions, causes of action, suits, debts, dues, sums of money, accounts, reckonings, covenants, contracts, controversies, agreements, promises, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, including for injury and death, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against Released Parties which any one or more of the Releasing Parties ever had, now have or hereafter can, shall, or may have, whether known or unknown, asserted or non-asserted, which may in any way arise out of or relate to your participation in this sweepstakes or the awarding, acceptance and use or misuse of a prize.

The Released Parties shall not be responsible for (i) any typographical or other error in the publishing or printing of the offer, administration of the sweepstakes on in the announcement of any prize; (ii) lost, late, misdirected, damage, illegible or incomplete entries, or postage due mail; (iii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; (iv) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the sweepstakes; or (v) the failure of any third party to comply with the instructions and proper administration of this sweepstakes. You agree that the Released Parties (defined above) shall not be liable for any injury, including death, loss or damage of any kind caused or claimed to be caused, by participation in this sweepstakes, or from the acceptance or use or redemption of any prize, including travel and accommodations provided by independent suppliers. In the event Sponsor and its agents are prevented from continuing with the sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, or local government law, order, or regulation, or order of any court or other cause not within their control, Sponsor and its agents shall have the right to modify, suspend, extend or terminate their sweepstakes.

This sweepstakes shall be governed by and interpreted under the laws of the State of Ohio, U.S.A., without regard to its conflicts of laws provisions that may require the application of the laws of another jurisdiction. Any and all disputes, claims, and causes of action arising out of or in connection with this sweepstakes shall be resolved individually, without resort to any form of class action. Any action or litigation concerning this sweepstakes shall take place exclusively in the federal or state courts sitting in Columbus, Ohio, and you expressly consent to the jurisdiction and venue in such courts and you waive all defenses for lack of jurisdiction and inconvenient forum with respect to such courts. You agree to service of process by mail or other method acceptable under the laws of the State of Ohio. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDEIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
